Charter Petition Process
Anyone interested in submitting a charter petition should contact the Superintendent's office for a complete copy of information regarding the submission of charter petitions for approval in accordance with these established timelines:
A letter of intent shall be submitted to the local Board and the Office of Charter School Compliance no later than 6 months in advance of the charter petition being submitted.
The final charter petition shall be submitted on or before January 1st.
The local board of education will vote to approve or deny a petition no later than June 30th.
The time frame between when the local board approves the charter petition and when the charter school is expected to begin serving students (the “pre-opening” period) shall be at least 6 months.
If the LBOE denies a charter petition, it shall within twenty (20) days provide to the charter petitioner and the State Board of Education (SBOE) a written explanation setting forth its reasons for denial and a list of deficiencies in the petition. If the reason for denial includes that approval is not in the public interest, such explanation shall include a detailed explanation as to why. A denial does not prevent a petitioner from resubmitting a revised petition that addresses the deficiences cited in the denial.
If the LBOE approves a charter petition, it shall within thirty (30) days provide a copy of the petition it approved to the State Department of Education (SDOE) for review by the SBOE.
